These Terms of Use (“Terms”) govern your access to trybalance.io and any Balance product features made available during early access (together, the “Services”). The Services are provided by Balance Systems, Inc. (“Balance”). By using the Services, you agree to these Terms.
1. Early access
Balance is pre-beta. The Services are provided on an as-is, as-available basis for evaluation. Features, availability, and data structures may change or disappear without notice. Don’t rely on the Services for anything mission-critical yet.
2. Your account and content
When you submit content (waitlist emails, contact messages, assistant prompts, or product data during a design-partner engagement), you keep ownership of it. You grant Balance a worldwide, non-exclusive license to host, process, and use that content solely to operate, secure, and improve the Services and to respond to you.
3. Acceptable use
You agree not to:
- Break the law or infringe someone else’s rights.
- Attempt to reverse-engineer, probe, or disrupt the Services or the underlying infrastructure.
- Upload malware or use the Services to send spam.
- Impersonate anyone or misrepresent your affiliation.
- Scrape, resell, or benchmark the Services without our written permission.
4. Third-party services
The Services depend on third-party providers (see our Privacy Policy for the list). Their terms apply to their pieces. We choose partners we trust, but we’re not responsible for their acts or omissions.
5. Disclaimers
To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated output (including the on-page assistant) may be wrong; verify anything material.
6. Limitation of liability
To the maximum extent permitted by law, Balance and its officers, employees, and contractors will not be liable for indirect, incidental, consequential, special, or exemplary damages, or lost profits or revenue, arising out of or in connection with the Services. Our aggregate liability for any claim relating to the Services will not exceed one hundred U.S. dollars (USD $100).
7. Termination
We may suspend or terminate your access to the Services at any time if we believe you’ve violated these Terms or if we’re required to by law. You can stop using the Services at any time.
8. Changes
We’ll update these Terms as the product grows. Material changes will be dated at the top. Continued use after a change constitutes acceptance.
9. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Exclusive venue for any dispute is the state or federal courts located in Delaware.
